THEORETICAL BASES OF THE RIGHTS AND THE LAW ON THE RIGHTS OF HOMOSEXUAL, BISEXUAL, TRANSGENDER AND INTERSEX PERSONS
Abstract
In Vietnam, homosexual, bisexual, transgender and intersex persons are the subjects in whom the research interests of the scientists are increasing. In the legal science, some theoretical issues on the rights and the law on the rights of those subjects have not yet been thoroughly examined. The paper offers interpretations of the nature of the rights of those subjects, the reasons why the law must recognise their rights and the contents of the law on the rights of homosexual, bisexual, transgender and intersex persons. The paper agues that the nature of the rights of homosexual, bisexual, transgender and intersex people is the natural needs of human beeings which must be recognised and protected by the law to realise and protect them in practice.
