INTENATIONAL STANDARDS AND EXPERIENCE OF SOME COUNTRIES ON RESTORATIVE JUSTICE
Cao Thị Oanh
Abstract
Restorative justice is a process of dealing with a case of law violation in which all parties relating to the case or the act of law violation together handle the case of law violation under the arrangement of a competent person or organisation. This process of handling criminal cases has many advantages and it has been applied in many countries for many years but restorative justice is still a new issue in Vietnam. The paper analyses some theoretical and practical issues of restorative justice including: the concept of restorative justice; international standards of restorative justice and the practice of implementing restorative justice in some countries (Australia, Canada and United States); and proposals for promoting restorative justice for dealing with minors commiting crimes in Vietnam.
