CONSTITUTIONAL LIABILITY IN THE CURRENT CONTEXT OF LEGAL REFORM AND THE NEED FOR CONTROLLING STATE POWERS IN VIETNAM

Abstract

The article argues for the necessity of recognising constitutional liabibity as a legal liability in Vietnam. Constitutional liability, on the one hand, fills the gaps and shortcomings of legal theory, clarifies the boundary between legal liability and political liability, and thus resolving various problems arising in practice; on the other hand, it greatly contributes to improving the models and methods of organising state powers in Vietnam in adherence to the rule of law and democracy orientation, thereby enhancing separation of powers and especially assisting in the process of controlling state powers in Vietnam.
