FISHERIES SUBSIDIES RULES UNDER THE COMPREHENSIVE AND PROGRESSIVE AGREEMENT FOR TRANS-PACIFIC PARTNERSHIP AND THE IMPACTS ON VIETNAM

Abstract

In comparison with the approach of some international instruments to the issue of fisheries subsidies, the one which has been offered by the CPTPP is morelegally binding. The fisheries subsidies rules under the CPTPP can have significant impacts on the Vietnamese legal system as well as on the implementation of Vietnam’s commitments in this regard. The positive impacts which can be attributed to the implementation of these rules are that it will contribute to well implementing the Vietnam Sustainable Marine Economic Strategy to 2030 and vision to 2045 and to promoting the export of legally caught fishery products. On the other hand,  Vietnam will be facing some problems such as the absence of specific rules on prohibitingcertain types of fisheries subsidies; the lack of a mechanism for receiving and dealing with public submissions;and the problem of  respect for the tranparency obligations.
