Compensation for non-contractual damages in private international law under the impacts of the fourth industrial revolution

Abstract

The 2015 Civil Code has included amendments and supplements to improve the legal provisions applicable to relations regarding compensation for non-contractural damages in private international law. However, under the impacts of the fourth industrial revolution, the limitations of these provisions have been revealed as they are not able to adjust many relations regarding compensation for non-contractual damages, especially those arising in the internet environment such as relations regarding harm to honour, dignity, reputation, intellectual property on the internet, and etc. Thus, it is neccessary to continue to supplement legal provisions applicable to relations regarding compensation for non-contractural damages involving foreign elements, meeting the requirements of the fourth industrial revolution. In doing so, studying international experience may suggest the lawmakers of Vietnamvaluable directions to set forth specific legal provisions and connecting factors which are supplemented to the principle provisions of Article 687of the 2015 Civil Code.
