Improving the provisions of the 2015 Criminal Procedure Code on arrest of suspects and defendants for detention

Abstract

Arrest of suspects and defendants for detention  is a commonly implemented preventive measure in criminal procedure of Vietnam. Together with detention, this measure has promoted its role in preventing crimes and facilitating investigation, prosecution, trial and judgment enforcement. As  the implemention of arrest of suspects and defendants for detention  is normally in connection with that of detention, not many research works focusing on this preventive measure have been found.  To enhance the effectiveness of implementing arrest of suspects and defendants for detention, the paper analyses the inadequacies of the related provisions of the 2015 Criminal Procedure Code and offers some recommendations for improving those provisions in question.
