Right to request a divorce seen from the thereotical perspective and the practical implementation

Abstract

The paper  analyses the concept, the legal nature and the contents of the right to request a divorce under the current law. It also points out the difficulties and inadequacies arising in  the pratice of implementing the right to request a divorce. On that basis, the paper offers some proposals to improve the law in this regard such as: defining the representative status of a parent or relative when they request a divorce on behalf of husband or wife; and imposing limitations on the  right to request a divorce of husband in case of reproduction with the assistance of reproductive techonogy and surrogacy.
