Abstract

Right to a hearing by an indepedent and impartial court within a reasonable time in civil procedure severs as an important legal ground to protect legitimate rights and interests of parties  before the court. Thus, it is of necessity to research international legal  documents and experiences in this regard and thereby to compare and assess the current situation of the law of Vietnam in  the context of judicial reform and international integration. The paper  offers a study of the right to a hearing by an independent and impartial court within a reasonable time in civil procedure under international legal documents on human rights and it comes up with recommendations for ensuring this basic procedural right  of parties in civil procedure of Vietnam.
