The issues of establishment and termination of national assembly deputies’ status - Inadequacies and recommendations for improvement

Abstract

The paper analyses the inadequacies of the implementation of legal provisions on the establishment of National Assembly deputies’ status, application to resign from performing the tasks of a National Assembly deputy, automatic loss of the rights of National Assembly deputies, suspension of the rights of National Assembly deputies and removal from office of National Assembly deputies. On that basis, the paper offers some recommendations for improvement, which include: amending Article 38 of the 2014 Law on Organisation of the National Assembly, adding some cases regarding the automatic loss of the rights of National Assembly deputies; promulgating legal provisions on the procedures for removal from office of National Assembly deputies and etc.
