Current situation of Vietnam’s anti-dumping investigations and some issues raised

Abstract

Anti-dumping measures can be used as one of the trade remedies to ensure a fair competition in the importing country. Since the promulgation of the first anti-dumping regulations, Vietnam has investigated three cases. Based on the analysis of the current situation of these anti-dumping investigations, the paper highlights some noticeable legal issues, including the compliance with WTO-anti-dumping rules and the application of foreign law in anti-dumping investigation.  Based on that the paper proposes some recommendations to emphasise the need to strictly comply with the WTO rules while anti-dumping investigations are being conducted and to improve the anti-dumping law of Vietnam.
