Right to remain silent in the US criminal justice throughout the two latest predecents
Abstract
The paper examines Berghuis v. Thompkins, 560 U.S. 370 (2010) and Salinas v. Texas, 570 U.S. (2013) in the U.S criminal justice and draws some issues relating to invoking the right to remain silent, the relationship between the right to remain silent and the right to counsel, and the range of the right to remain silent beyond the investigation period. These are the necessary theoretical knowledge for Vietnam in the context that the right to remain silent still remains controversial.
