Difficulties and inadequacies in the implementation of the 2014 Law on bankruptcy and some recommendations for improvement

Abstract

On the basis of the practice of hearing brankruptcy cases at court in Vietnam in recent years, the paper offers an explanation of the causes of the practical obtacles by analysing the inadequacies and limitations of the current law on procedures dealing with brankruptcy, asset management officers and the time limits for dealing with bankruptcy. The paper also offers recommendations to improve and promote the regulating effectiveness of the law on bankruptcy.
