Ideas of restricting human rights and the principle of restricting constitutional fundamental rights under the 2013 Constitution

Abstract

The principle of restricting human rights and citizens’ rights - constitutional fundamental rights is one of the new progressive provisions of the 2013 Constitution of Vietnam. There currently exist different viewpoints on this principle. The paper offers its own interpretation of the principle of restricting constitutional fundamental rights and explains the grounds for this interpretation. The paper argues that under this principle, constitutional fundamental rights in Vietnam can be restricted by law or other legal normative documents providing that the restriction has been projected in law.
