Provisions of the 2015 Civil Code on guardianship and the shortcomings that are in need of overcoming

Abstract

The paper analyses the role of the legal institution of guardianship. It briefly introduces main issues relating the provisions of the 2015 Civil Code on guardianship such as: subjects of guardianship relations, purposes of guardianship, cases of guardianship, cases where the minor need to have the guardian, priorities of applying the gounds for defining the guardian and etc. On the basis of studying the status quo of the law, the paper analyses, comments on, and clarifies the shortcomings of the provisions on guardianship and offers recommendations to improve the Civil Code in this regard.
