Crimes infringing upon traffic safety under the 2015 Criminal Code and some proposals for improvement

Abstract

To better deal with crimes infringing upon traffic safety, many relevant amendments have been incorporated into the 2015 Criminal Code. However, the provisons on quantitative signs of those crimes do not really fit with cases where committed criminal acts cause different types of consequencies; and the provisions on cases where committed criminal acts may cause the practical likelihood of certain consequencies if they are not timely stopped lead to different understandings regarding the types of legal requirements for crime elements as well as the forms of mens rea. These problems require a further improvement of the Criminal Code or timely issuing guiding documents.
