Characteristics of the arbitration clause and experiences for contracting parties of international commercial contracts

Abstract

Based on the provisions of international law and the law of Vietnam relating to the arbitration clause such as those of the 1958 New York Convention, the UNCITRAL Model Law on International Commercial Arbitration, the 2015 Civil Procedure Code and the 2010 Law on Commercial Arbitration, the paper analyses some characteristics of the arbitration clause and draws experiences for the contracting parties of international commercial contracts during the course of drafting the arbitration clause.
