Abstract

Compensation, assistance, and resettlement, when the State reclaims land, are critical facets of state land management. These directly impact the rights and legitimate interests of land users from whom land is taken. This article delves into an analysis and evaluation of the challenges in the provisions of the Draft Land Law (amended) concerning compensation, assistance, and resettlement policies when the State reclaims land for national defense, security purposes, or socio-economic development in the national or public interest. Based on this analysis, the article offers proposals for legal enhancements on this topic.
