Abstract

Since the introduction of Decree 67/2014/CP on July 7, 2014, regarding fisheries development policies, fishermen have been afforded the opportunity to borrow money for the purchase and construction of large offshore fishing vessels. Concurrently, they can enter into fishing vessel insurance contracts with insurance enterprises. While there are positive aspects to this decree, it has also given rise to numerous disputes over fishing vessel insurance contracts. Although the Courts' verdicts have largely upheld the legitimate rights and interests of fishermen and other concerned parties, many cases have faced delays or multiple trials. This has posed challenges for fishermen, directly impacting the interests of all parties involved in the insurance contract due to various legal complexities. Drawing from adjudication experiences, this article highlights issues encountered in resolving

fishing vessel insurance contract disputes under Decree 67/2014/ND-CP. It also suggests measures to address these challenges with the aim of refining relevant laws. Such enhancements would provide assurance to individuals and businesses investing in fishing activities, bolstering the protection of national sovereignty over sea

and islands.
