The supervising right of citizens in infrastructure construction investment

Abstract

Investment supervision is recommended by Vietnamese law as one of the necessary statements that need to be implied in investment management. Responsibility for implementing investment supervision activities is assigned to investors and state agencies.  In addition, Vietnamese law also recognizes the right of citizens to supervise investment through the supervision of the community.  However, the effectiveness of the supervision of the community in infrastructure investment cause some inconvenience issues with different point of view due to the PPP complications.

This article analyzes the legal provisions on community surveillance activities in Vietnam. Thereby, pointing out the shortcomings and limitations in the effectiveness of community surveillance in monitoring infrastructure investment.  Also, it proposes solutions to improve the effectiveness of community supervision activities from the practice of law enforcement on citizens' right to investment supervision.
