DETERMINATION OF LAND CONDITIONS WITHOUT DISPUTES WHEN CONTRIBUTING CAPITAL INTO ENTERPRISE BY LEGAL SCIENCE ABOUT LAND IN OUR COUNTRY

Abstract

On November 29, 2013, The 6th session, term XIII, of the National Assembly of the Socialist Republic of Vietnam has passed the Land Law, which took effect nationwide from July 1, 2014. The 2013 Land Law has replaced the 2003 Land Law, continuing to institutionalize the economic reform policy of the Party and the State for timely and uniformed application to accelerate the process of economic and social development. This Law regulates the activities of state agencies exercising the powers and responsibilities of representing the entire people's ownership of land, performing the task of performing the unified state management of land, especially uniformly apply to protect the legitimate rights and interests of land users and other subjects related to the management and use of land.

The author focuses on analyzing the inadequacies of undisputed land when land users contribute capital to enterprises under the lens of current land law, thereby proposing specific recommendations to improve the right to contribute capital to enterprises with land use rights of organizations and individuals in the country.
