SOME OPINIONS ON CAPITAL CONTRIBUTION AND HANDLING OF TERMINATION OF CAPITAL CONTRIBUTION BY LAND USE RIGHTS IN THE REAL ESTATE MARKET IN VIETNAM

Abstract

Issues of form and validity of capital contribution transactions, procedures for capital contribution by land use rights for real estate business as well as issues of handling land use rights upon termination of capital contribution contracts have been recognized and stipulated in the land law and relevant legal documents. However, in addition to the positive achievement, the legal regulations governing these issues still exist certain problems and limitations. Starting from that fact, the article focuses on research, analysis and assessments to point out some limitations and shortcomings in regulations on the form and effect of capital contribution transactions, procedures for capital contribution by land use rights for real estate business as well as issues of handling land use rights when terminating capital contribution contracts, thereby introducing some solutions to propose perfection on this issue.
