THE LAW ON PROMULGATION OF LEGAL DOCUMENTS IN 2015 AND ISSUES RAISED FROM PRACTICE

Abstract

The Law on Promulgation of Legal Documents in 2015 and Decree No. 34/2016/ND-CP detailing a number of articles and measures to implement the Law on Promulgation of Legal Documents (both amended and supplemented in 2020) has been being the legal basis for the construction and promulgation of legal documents in Vietnam. On the basis of analyzing a number of problems and inadequacies of current legal regulations on (i) competence, procedures and forms of documents on suspension of execution or annulment of illegal documents, (ii) the content of the concept of legal documents, (iii) the timeline for determining the validity of legal documents of the People's Council and the People's Committee, and (iv) deadlines for sending legal documents for publication in the Official Gazette or for public posting, the article has given some views to further improve these legal provisions.
