THE LIMITATION OF CONSTITUATIONAL RIGHTS IN THE CONTEXT OF COVID-19 IN VIETNAM

Abstract

Constitutional rights are rights recognized and protected by the Constitution, reflecting the State’s obligation to ensure the exercise of rights of individuals in society. However, the Covid-19 pandemic has caused serious impacts to the World and Vietnam, which not only affects the life and health of each individual but also threatens the economy, politics and social stability of nations. Each country has had different response measures within its capabilities. But these epidemic prevention measures at the same time have raised concerns about affecting the constitutional rights of members of society. Therefore, in this scientific report, the author will focus on analyzing and clarifying the concept of the constituational rights and the limitations of rights, thereby providing the concept of “the limitations of constitutional rights”; analyzing and clarifying practices of limitations of constitutional rights in the context of Covid-19 in Vietnam, thereby proposing ideal solutions to complete the legal basis in terms of the limitations of the constitutional rights in Vietnam.
