EXERCISING THE RIGHT OF PROSECUTION IN CRIMINAL PROCEEDINGS IN VIETNAM AND SOME OTHER COUNTRIES – SOME IMPLICATIONS FOR VIETNAM

Abstract

The right of prosecution and the exercise of such right are largely mentioned in the criminal procedure laws when referring to the functions of the all-level procuracies. In the science of criminal procedure, defining the concept of the right of prosecution and its exercise have essential theoretical and practical significance. Solving that problem helps to determine the role and position of the procuracy in the judicial system; clearly define the functions of the procuracy; thereby making the right decisions on structuring the procuracy agencies at all levels. This article focuses on the concept of the right of prosecution and its implementation in Vietnam and in some countries around the world, thereby drawing some experiences for Vietnam.
