Bài viết tìm hiểu về luật tục và tri thức bản địa của người Tà Ôi đối với tài nguyên rừng trên các khía cạnh:- Quan niệm của người Tà Ôi về các loại rừng (rừng đầu nguồn, rừng thiêng, rừng ma, rừng khai thác sản xuất).- Luật tục và tri thức bản địa của người Tà Ôi trong việc sở hữu, khai thác và bảo vệ tài nguyên rừng.Chính những tri thức và luật tục tồn tại từ bao đời nay đã giúp cho người Tà Ôi giữ được những cánh rừng nguyên sinh cuối cùng còn sót lại. Tuy nhiên, làm thế nào để những tri thức và luật tục ấy thích ứng với xã hội hiện đại, nhất là tránh được những xung đột giữa quan niệm sở hữu đất rừng truyền thống với pháp luật hiện hành là những vấn đề cấp thiết cần quan tâm nghiên cứu.
ABSTRACT
CUSTOMARY LAW AND INDIGENOUS KNOWLEDGE OF THE TÀ ÔI PEOPLE TOWARD FOREST RESOURCES
The article explores the customary law and indigenous knowledge of the Tà Ôi people toward forest resources on the following aspects:- The concept of the Tà Ôi on various kinds of forests (headwater forests, spiritual forests, ghost forests, forests for exploitation).- Customary laws and local knowledge of the Tà Ôi in possessing, exploiting and protecting forest resources.It is the customary law and indigenous knowledge existing for centuries that has helped the Tà Ôi people preserve the last remaining primeval forests. However, the urgent matter to be reformed is to make those customary law and indigenous knowledge adapt to modern society and to avoid the conflict between the concept of traditional forest land ownership and the current law.
