HUMAN RIGHTS PROTECTION IN A STATE OF EMERGENCY IN THE LAWS OF SOME COUNTRIES AND OF VIETNAM

The concept of “state of emergency”,“state of exception”,“state of alarm” or “state of siege”- collectively known as special situations, has long been
recognized in the law of many countries, regardless of their political systems. The paper presents the analysis of legal regulations on a state of emergency, especially the provisions on human rights protection in this context of some countries and of Vietnam. Based on that, the authors draw an initial comparison of the legal framework for this issue of Vietnam with other countries; then, propose some recommendations for Vietnam
in perfecting the law on a state of emergency towards both protecting human rights and facilitating state agencies in addressing issues emerging in a state of emergency.
