Enhancement of commercial disputing party's awareness on arbitration agreements in Vietnam

Abstract

    The paper focuses on the limitations of arbitration agreements in trade disputes. From this situation, the paper proposes a number of solutions on the view points of the disputing parties who have chosen arbitration, in order to rectify the invalidity of arbitration agreement, to improve the effectiveness of arbitration approach in Vietnam. Such agreement helps businesses to grasp the rules of arbitration agreements, prevent loss and damages, capture business opportunities and reduce the burden of the court system when addressing commercial disputes.
